Who raises my children if my spouse and I both die without a will in Texas?

A Texas probate court appoints the guardian. The judge weighs competing petitions from relatives and rules on the best interest of the child. Your preference carries no legal weight unless you recorded it in a written designation of guardian under the Texas Estates Code.

At what age do my children inherit if I have only a will?

Age 18. A will alone hands a Texas eighteen year old the full inheritance with no restrictions and no oversight. A children’s trust lets you set the ages, the purposes, and the trustee who manages the money until then.

Do parents with young children need a trust, or is a will enough?

Most Texas parents with minor children benefit from a revocable living trust. It keeps the plan private, avoids the probate delay that leaves a guardian waiting on funds, and controls the timing of every distribution to a child. A will still plays a role as the pour over safety net.

What does an estate plan cost at Reyna Law?

What happens to my plan when we have another child?

A well drafted plan covers children born after signing. We still recommend a review after any birth, adoption, marriage, divorce, move to another state, or major change in assets.
